MEMORANDUM OPINION


Appellant's notice of appeal was filed May 17, 2004. In a letter dated May 19, 2004, the Court informed appellant his $125 filing fee was due. We instructed appellant to pay the fee within ten days and cautioned him that the failure to do so would result in the dismissal of his case.

On June 2, 2004, the Court received an unsigned and untimely affidavit of indigency. The following day, the Court returned appellant's affidavit of indigency, informing him that this was not the proper court for filing the document.

On July 1, the Court received notice from the district clerk that appellant had not paid the fee for the clerk's record. In our July 6, 2004 letter to appellant, we instructed him to provide us with written verification that he had paid or made arrangements to pay for the clerk's record or written documentation that he had been found indigent and would be allowed to proceed without payment of costs. We cautioned appellant that the failure to provide such verification or documentation within ten days of the date of that letter would result in the dismissal of his appeal for want of prosecution.

To date, appellant has not filed his $125 filing fee, nor has he provided the information requested in our July 6th letter. Accordingly, we DISMISS this appeal for want of prosecution. See Tex.R.App.P. 42.3(b).
