Respondent having moved for an extension of time to file and serve a brief on this CPLR article 78 proceeding transferred to this Court by an order of the Supreme Court entered in the Office of the Clerk of the County of Wyoming on December 26, 2013,

Now, upon reading and filing the affirmatoin of Marcus J. Mastracco, Esq., dated March 31, 2014, the notice of motion with proof of service thereof, and the responding affirmation of Leah Rene Nowotarski, Esq., dated April 9, 2014, and due deliberation having been had thereon,
