WOLF, Judge.

Appellant appeals the denial of his motion to dismiss the petition charging delinquency due to escape from a juvenile facility in violation of section 39.112, Florida Statutes (1989). We find the issue to be identical to that in R.A.H. v. State, 614 So.2d 1189 (Fla. 1st DCA 1993), and we reverse.
