On August 30, 2023, Appellant Christy Lyn Ivy-Phillips filed a notice of appeal from the trial court's order signed on July 31, 2023 "Sustaining [Appellee] Melody Royall's Amended Special Exceptions to Contestant's Pleading Dismissing Contestant's Letter to Judge in Notice on Demand, Filed on November 4, 2021, and Supplemented/Amended on November 8, 2021." On February 26, 2024, Appellee filed a Motion to Dismiss for Lack of Jurisdiction on the ground that the order sustaining special exceptions from which Appellant appeals does not constitute an "appealable final or interlocutory order."

We request a response to the Motion to Dismiss from Appellant. The response(s), if any, is due on or before Monday, March 25, 2024. The Court may dismiss this appeal for want of jurisdiction without further notice unless Appellant files a written response that demonstrates, with citation to the record, statutes, rules, and case law, why this Court has jurisdiction over the appeal. See Tex. R. App. P. 42.3(a).

On March 8, 2024, Appellant filed her Objections to and Motion to Strike Appellee's Brief as Untimely arguing that Appellee's brief was "received and filed on February 27, 2024[,]" one day past the due date. Appellant's Motion to Strike APPELLEE'S Brief as Untimely is denied.

It is so ORDERED.
