ORDER

The trial court imposed sentence on December 16, 2016. A motion for new trial was therefore due January 17, 2017 (January 16, 2017 was a holiday). See TEX. R. APP. P. 21.4(a). Appellant filed a motion for new trial on January 20, 2017. In the absence of a timely motion for new trial, the notice of appeal was due January 17, 2017. See TEX. R. APP. P. 26.2(a)(1), 26.3. Appellant filed his notice of appeal on January 20, 2017. Appellant did not file a motion for extension of time to file the notice of appeal.

Because it appears appellant did not timely file his notice of appeal, appellant is hereby ORDERED to show cause in writing no later than May 29 , 2017 why this appeal should not be dismissed for lack of jurisdiction.
