Case No. 2:03CV1052 DAK (D. Utah Jul. 9, 2004)

Opinion

Case No. 2:03CV1052 DAK.

July 9, 2004

ORDER

On May 27, 2004, this court issued an Order granting Defendant's Motion for a More Definite Statement, and stating failure to file the statement June 21, 2004 would result in dismissal of this action without prejudice. On June 23, 2004-two days after the deadline-Plaintiff filed a Motion for Extension of Time to Respond. Plaintiff's counsel indicated that he could complete the More Definite Statement by July 2, 2004, explaining that he had experienced personal trauma, which inhibited his work, and also that he was going out of town. Plaintiff did not file any statement on July 2, 2004.

Accordingly, the court HEREBY ORDERS that Plaintiff must file and serve a More Definite Statement-in the form of an Amended Complaint-no later than July 20, 2004 at 5:00 p.m. If the court has not received an Amended Complaint by this date, the action will be dismissed without prejudice. No further extensions will be granted absent extremely compelling circumstances. Additionally, the court suggests that Plaintiff's counsel contact the Office of the Clerk of the Court to register for the Court's email notification system, which will permit counsel to receive notification the Court's Orders and Notices on a more timely basis.
