By Notice served December 12, 2023, this case was calendared for trial on the Court's Baltimore, Maryland trial calendar, which commenced on April 8, 2024.
On February 23, 2024, respondent filed a Motion for Judgment on the Pleadings. Furthermore, the Commissioner stated that he has been unable to reach petitioner Mustafe A. Ismail, so Mr. Ismail's views on the motion are unknown.
On February 28, 2024, the court served an Order on petitioner instructing him, on or before March 28, 2024, to file an objection, if any, to the Commissioner's motion for judgment on the pleadings and that failure to comply with this Order may result in the granting of the motion and a decision may be entered against petitioner. To date petitioner has not responded.
When this case was called from the calendar on April 8, 2024, at the Baltimore, Maryland Trial Session of the Court, there was no appearance by nor anyone on behalf of petitioner. Respondent's counsel appeared and was heard on the motion. Upon due consideration and for cause more fully appearing in the transcript of the proceedings, it is
ORDERED that respondent's Motion for Judgment on the Pleadings is taken under advisement. It is further
ORDERED that on or before May 8, 2024, petitioner shall file, in writing, a response to respondent's Motion for Judgment on the pleadings and that failure to do so may result in the granting of the motion and a decision may be entered against petitioner. It is further
ORDERED that jurisdiction of this case is retained by the undersigned.
