ORDER DIRECTING PLAINTIFF TO CURE DEFICIENCIES
Plaintiff, David Isberg, is in the custody of the Colorado Department of Corrections and currently is incarcerated at the Denver Reception and Diagnostic Center in Denver, Colorado. Plaintiff, acting pro se, initiated this action by filing an Application for a Writ of Habeas Corpus Pursuant to 28 U.S.C. § 2254 and a Prisoner's Motion and Affidavit for Leave to Proceed Pursuant to 28 U.S.C. § 1915 in a Habeas Corpus Action. Although Plaintiff has filed his claims on a Court-approved form that used in challenging the validity of his conviction, the claims he raises involve adequate medical treatment and are more properly raised in an action filed pursuant to 42 U.S.C. § 1983.
As part of the Court's review pursuant to D.C.COLO.LCivR 8.2, the Court has determined that the submitted documents are deficient as described in this Order. Plaintiff will be directed to cure the following if he wishes to pursue his claims. Any papers that Plaintiff files in response to this Order must include the civil action number noted above in the caption of this Order.
