And defendant-appellant having moved, pursuant to CPLR 5519(c), for an order granting a preliminary injunction and/or otherwise staying and tolling the running of the aforesaid order and all proceedings in this matter, including without limitation the deadline for pretrial submissions on January 4, 2022, the pretrial conference scheduled for January 7, 2022, and the jury trial scheduled to commence on February 2, 2022, pending hearing and determination of the appeal, And an interim stay having been granted by order of a Justice of this Court entered December 13, 2021, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is ordered that the motion is granted on the condition defendant-appellant perfects the aforesaid appeal for the April 2022 Term of this Court.
