On April 10, 2023, the Court served an Order on the parties instructing them to on or before June 6, 2023, submit to the Court either a stipulated decision or file a joint report (or separate reports, if preferred) regarding the then-present status of this case. On April 14, 2023, counsel for petitioner filed a report wherein they requested that the Court that grant them 60-90 days to see if any heirs are willing to engage the counsel to continue the suit. On April 19, 2023, the Court served an Order on the parties instructing them to on or before July 17, 2023, submit to the Court either a stipulated decision or file a joint report (or separate reports, if preferred) regarding the then-present status of this case. On July 14, 2023, the parties filed a Status Report indicating to the Court that respondent has spoken with the attorney for the Suffolk County Public Administrator (now Administrator for P's estate.) They were appointed only to deal with a creditor however they will seek to extend their authority to the full letters. If successful they will be able to deal with the Tax Court Proceeding. The parties request 90 days to file an additional Status Report.
Upon due consideration it is hereby
ORDERED that, on or before October 16, 2023, the parties shall submit to the Court either a stipulated decision or file a joint report (or separate reports, if preferred) regarding the then-present status of this case.
