Following review of the response, it is ordered that appellee's motion to dismiss appeal for lack of jurisdiction is granted, and this appeal from the Circuit Court for Miami-Dade County, Florida is hereby dismissed.

Upon consideration of appellee's motion for appellate attorneys' fees, it is ordered that said motion is conditionally granted and remanded to the trial court, subject to the trial court's ultimate determination of the prevailing party.
