Judgment affirmed, with costs. No opinion. Young, Kapper, Scudder and Tompkins, JJ., concur; Lazansky, P.J., dissents upon the ground that defendant was denied a jury trial, and upon the further ground that upon the proof submitted by the plaintiff there was a question of fact for the jury.
