STIPULATION AND ORDER DISMISSING ACTION WITH PREJUDICE
WHEREAS, plaintiff International Microcomputer Software, Inc. ("IMSI") and defendant and counter-claimant Imageline, Inc. ("Imageline") have entered into a written Settlement Agreement and Mutual General Release dated April 18, 2003 ("Settlement Agreement") fully and finally resolving, among other things, the above-entitled action; and
WHEREAS, the Settlement Agreement provides, among other things, that this action, including IMSI's first amended complaint and Imageline's counterclaim be dismissed with prejudice, each side to bear its own costs;
NOW, THEREFORE, IMSI and Imageline, through counsel, hereby stipulate that the above-entitled action be immediately dismissed in its entirety with prejudice, each side to bear its own costs.
ORDER
Pursuant to the above stipulation, and good cause appearing therefor, IT IS HEREBY ORDERED THAT the above-entitled action be and hereby is dismissed in its entirety with prejudice, each side to bear its own costs.
