Pending before the Court are the Commissioner's Motion to Compel Responses to Interrogatories and Motion to Compel Production of Documents, both filed October 20, 2023. On November 15, 2023, the Court heard argument on the pending motions. By Order served November 17, 2023, we provided the Commissioner an opportunity to file a supplement to his pending discovery motions in which he could propose a discovery approach that is more proportional to the needs of the case while permitting him to test the accuracy of Intermountain's sample.

On November 22, 2023, the Commissioner filed that supplement. On December 1, 2023, the Court held a conference call with the parties, during which Petitioner requested the opportunity to respond to the Commissioner's supplement. The Court also discussed with the parties the possibility of rescheduling the trial dates for this case. Consistent with the Court's discussions with the parties, it is

ORDERED that Petitioners may file a response to the Commissioner's supplement by December 15, 2023.
