ORDER OF DISMISSAL


The instant action was commenced by the filing of a Complaint on December 6, 2004. On August 11, 2005, this Court issued an Order allowing Plaintiff ten days in which to show cause why the Complaint should not be dismissed for failure to serve process on defendant within 120 days from the commencement of the action. To date, plaintiff has not complied with that Order. Accordingly,

IT IS HEREBY ORDERED that plaintiff's Complaint is dismissed without prejudice pursuant to Fed.R.Civ.P. 4(m).
