Ingram v. Bigelow

Appellate Division of the Supreme Court of New York, First Department
Feb 13, 1952
279 App. Div. 854 (N.Y. App. Div. 1952)

Opinion

February 13, 1952.

Present — Dore, J.P., Cohn, Callahan, Van Voorhis and Shientag, JJ.

Order, so far as appealed from, unanimously affirmed, with $20 costs and disbursements to the respondents. The complaint is sufficient on its face. The reasonableness of the negative covenant for plaintiffs' protection and the territorial extent in which it should be enforced, are for the trial court after the revelation of all the facts on the trial.
