ORDER MODIFYING OPINION AND DENYING REHEARING

[NO CHANGE IN JUDGMENT]

THE COURT:

It is ordered that the opinion filed herein on June 25, 2003, be modified in the following particulars:

1. On page 7, in the first full sentence (beginning "While the appeal"), both mentions of the year "1999" are deleted and replaced by the year "1998" so that the sentence now reads:

While the appeal did not toll the statute of limitations (Laird v. Blacker (1992) 2 Cal.4th 606, 614-615, 828 P.2d 691), the decision on June 11, 1998, affirming the trial court decision, and the decision on June 22, 1998, allowing Securacom to apply for attorney fees, served to put ISN on notice of the tactical error in litigating the cross-complaint.

2. On page 7, the third sentence of the first full paragraph (beginning "The material facts") is modified to delete the date "July 22, 1999" and to replace the date with "June 22, 1998" and, as modified, now reads:

The material facts relating to this exposure to this liability were revealed on June 22, 1998, when this court reversed the lower courts order denying attorney fees.

There is no change in the judgment.

The petition for rehearing is denied.
