ORDER

This is an appeal from an interlocutory order denying appellant's motion to compel arbitration of appellee's claim for injunctive relief. A companion appeal from an interlocutory order granting appellee a temporary injunction is currently pending under appellate cause number 05-20-00788-CV.

Before the Court is the parties' October 19, 2020 joint motion to abate proceedings. The parties explain the trial court granted appellant's motion to reconsider the denial of the motion to compel arbitration, and they assert the appeal will become moot once the arbitrator rules on any request for injunctive relief.

We GRANT the motion TO THE EXTENT we SUSPEND the briefing deadline and ORDER either (1) a motion to dismiss the appeal or (2) letter showing cause why this appeal should not be dismissed as moot given that the claim for injunctive relief is to be arbitrated be filed no later than December 21, 2020.
