Opinion delivered May 6, 1985
By Per Curiam Order we allowed time for interested persons to respond to the Petition of the Special Committee on the Model Rules of Professional Conduct. Within the time allowed we have received responses from Mr. Charles L. Carpenter, recommending the addition of a disclaimer to the proposed rules to the effect that while mandatory only upon members of the bar, the Model Rules should be considered as a guide and goal for elected officials; from the Supreme Court Committee on Professional Conduct urging adoption of the Model Rules; and from Mr. Dan M. Burge of the law firm of Reid, Burge, Prevallet and Coleman of Blytheville, Arkansas, generally favoring the Model Rules, but expressing concern as to the effect of Rules 1.6 and 1.8 upon the defense of claims by insurance carriers on behalf of their insured. Before taking final action on the petition we would like to have the comments of the Special Committee to the views expressed by Mr. Burge and will take no further action prior to November 4, 1985, to allow for such comments as the Special Committee may have.
