Consideration, by the Court of Appeals, on its own motion pursuant to N.Y. Constitution, article VI, § 22(e) and (g) and Judiciary Law § 44 (8)(a) and (c) of whether Honorable Edmund G. Fitzgerald should be suspended from his office of Judge of the Yonkers City Court, Westchester County, pending disposition of his request for review of a determination by the State Commission on Judicial Conduct.

Chief Judge Kaye and Judges Smith, Levine, Ciparick, Wesley, Rosenblatt and Graffeo concur.


On the Court's own motion, it is determined that Hon. Edmund G. Fitzgerald is suspended with pay, effective immediately, from the office of Judge of the Yonkers City Court, Westchester County, pending disposition of his request for review of a determination by the State Commission on Judicial Conduct.
