In the Matter of Shakeri v. Travis

Appellate Division of the Supreme Court of New York, Third Department
Apr 28, 2005
17 A.D.3d 955 (N.Y. App. Div. 2005)

Opinion

96437.

April 28, 2005.

Appeal from a judgment of the Supreme Court (Cannizzaro, J.), entered July 26, 2004 in Albany County, which dismissed petitioner's application, in a proceeding pursuant to CPLR article 78, to review a determination of the Board of Parole denying petitioner's request for parole release.

Farhad Shakeri, Otisville, appellant pro se.

Eliot Spitzer, Attorney General, Albany (Nancy A. Spiegel of counsel), for respondent.

Before: Spain, J.P., Mugglin, Rose, Lahtinen and Kane, JJ., concur.

Since the determination giving rise to this CPLR article 78 proceeding, petitioner has reappeared before the Board of Parole and again was denied parole release. Given petitioner's subsequent reappearance before the Board in January 2005, the instant matter is now moot and must be dismissed ( see Matter of Rivera v. Travis, 8 AD3d 716).

Ordered that the appeal is dismissed, as moot, without costs.
