MEMORANDUM OPINION

PER CURIAM.

On December 5, 20008, appellant John A. Thompson, Jr. filed a notice of appeal in this case. On July 7, 2009, we granted appellant's motion to extend his time to file his brief until August 31, 2009. We warned appellant that if a brief had not been filed by that date, this appeal would be dismissed. To date, appellant has not filed the brief or otherwise communicated with the Court regarding this appeal.

Accordingly, we DISMISS this appeal. See Tex. R. App. P. 38.8(a)(1).
