ORDER

BILL PEDERSEN, III JUSTICE

Before the Court are appellant's June 13, 2024 motion seeking an extension to June 21, 2024 to file his brief and appellant's June 14, 2024 motion for leave to file an out of time brief. We GRANT the motion for leave and ORDER the brief received June 14 filed as of the date of this order. We DENY as moot the extension motion.

We note that, pursuant to Texas Rule of Appellate Procedure 34.5a, appellant elected to file an appendix in lieu of the clerk's record. See Tex. R. App. P. 34.5a(a). The appendix, however, does not contain all the documents required by the rule. Specifically, the appendix does not include the (1) December 27, 2022 first amended petition for divorce; (2) December 29, 2022 first amended counterpetition for divorce; (3) December 11, 2023 request for findings of fact and conclusions of law; (4) January 29, 2024 amended motion to reconsider; (5) January 29, 2024 motion for new trial; or (6) March 20, 2024 notice of appeal. See id. 34.5(a), 34.5a(e). Accordingly, we ORDER appellant to file a supplemental appendix containing these items no later than June 27, 2024. See id. 34.5a(d).

Appellee's brief shall be filed within thirty days of the filing of the supplemental appendix.
