DECISION AND ORDER ON MOTION
Motion by Kids in Need of Defense for permission to file a brief amicus curie upon the appeal and to take judicial notice of redacted Family Court and Surrogate's Court orders.
Upon the papers filed in support of the motion, and no papers having been filed in opposition thereto, it is
ORDERED that the motion to take judicial notice of the redacted Family Court and Surrogate's Court orders is denied, without costs, and without prejudice to the issue involved being raised upon the argument of the appeal, and it is further
ORDERED that the motion for permission to file a brief amicus curiae is granted, without costs, and Kids in Need of Defense shall file and serve a revised brief amicus curiae upon the appeal which shall include the redacted Family Court and Surrogate's Court orders as an addendum to the brief, on or before October 30, 2017.
