Original Mandamus Proceeding

This proceeding arises out of Cause No. 2014-10-0900-CVA, styled Roy Alaniz v. Raymond Ybarra, Jr. and Wildblue Equipment, LLC, pending in the 81st Judicial District Court, Atascosa County, Texas, the honorable John D. Gabriel Jr. presiding.

ORDER

Sitting: Sandee Bryan Marion, Chief Justice Karen Angelini, Justice Marialyn Barnard, Justice

On April 19, 2017, Relators filed a petition for writ of mandamus. On April 24, 2017, Relators filed a motion to stay proceedings. On May 18, 2017, the real party in interest filed a response opposing the motion to stay. This court is of the opinion that a serious question concerning the mandamus relief sought requires further consideration. See TEX. R. APP. P. 52.8(b). The respondent and the real party in interest may file a response to the petition for writ of mandamus in this court no later than June 6, 2017. Any such response must conform to Texas Rule of Appellate Procedure 52.4.

Relators' Motion to Stay Proceedings is GRANTED. All proceedings in the underlying case are stayed pending final resolution of the petition filed in this court.

It is so ORDERED on May 22, 2017.
