ORDER APPROVING THE SETTLEMENT OF CLAIM NO. 8683 FILED BY RICHARD JACKOB (22ND OMNIBUS CLAIM OBJECTION)
It appearing that the Debtors have reached an agreement resolving their claim objection with respect to claim number 8683 filed by Richard Jackob ("Claimant") as set forth hereafter, it is hereby
ORDERED that based on the written agreement of the parties dated June 17, 2005, claim number 8683 filed by Richard Jackob shall be treated as set forth in such agreement and as follows: Claim No. 8683 shall be reduced and allowed so that Claimant shall have an allowed, general unsecured claim in the Bankruptcy Cases in the amount of $40,000.00, to be paid as a Class 4 convenience claim under the Plan. Payment of such claim shall be made in accordance with, in the amounts set forth under, and at the times provided for in, the Plan. One-quarter of this gross sum is for an amount attributable to non-economic payment in settlement of any and all claims for mental anguish, humiliation, embarrassment or other claims of tort damages that Claimant allegedly may have suffered for alleged emotional distress and personal non-physical injuries, and for attorney's fees and costs (if any) (to be reported on IRS Form 1099). Three-quarters of this gross sum shall be subject to appropriate payroll deductions for an amount attributable to payment for lost wages (to be reported on IRS Form W-2).
