ORDER


On January 6, 2004, Elaine L. Chao, the United States Secretary of Labor ("the Secretary"), moved this Court for leave until January 16, 2004 to file a brief as amicus curiae to address issues raised by defendants in their motions to dismiss. On January 8, 2004, this Court issued an order requiring opposition to the Secretary's motion be filed by January 12, 2004. On January 12, 2004, the Individual Defendants filed a response which did not oppose the Secretary's motion. It is hereby

ORDERED that the Secretary's motion for leave until January 16, 2004 to file a brief as amicus curiae is granted. Any response to the Secretary's brief is due January 30, 2004.
