MASTER FILE 02 Civ. 3288 (DLC)
December 23, 2003
ORDER
Through an Order of November 25, 2003, the parties in the consolidated WorldCom Securities Litigation were required to identify any material which had been filed under seal in this case and which they desired to keep sealed. The Underwriter Defendants and the Lead Plaintiff made submissions supporting continued sealing of certain documents.
At a hearing held on December 18, the Court ruled on the proposed submissions. In essence, the Court found that Underwriter Defendants and Named Plaintiff HGK may redact the information from the submitted documents which would identify the clients of and/or investors with the Underwriter Defendants and HGK. The rulings made on the record at the December 18 conference, as opposed to this summary of those rulings, shall govern the redactions to be made from all materials already filed in this litigation. Accordingly, it is hereby
ORDERED that counsel for the Underwriter Defendants and for Lead Plaintiff shall re-file in the public record the following documents, which are identified by the date of filing and docket number, by January 16, 2004, with redactions that conform to the rulings made on December 18.
1) October 10, 2003 Supplemental Report of Lucy P. Alien, Docket No. 447, 448 or 449
2) October 17, 2003 Reply Memorandum of Law of Lead Plaintiff in Support of Class Certification, Docket No. 528 or 530.
3) October 17, 2003 Declaration of Mark R. Rosen, Docket No. 529
4) October 17, 2003 Report of Lucy P. Alien, Docket No. 555
5) October 17, 2003 Underwriter Defendants' Memorandum of Law in Opposition to Class Certification, Docket No. 535
6) October 17, 2003 Underwriter Defendants' Surreply Memorandum of Law in Opposition to Class Certification, Docket No. 454
7) October 17, 2003 Declaration of Jay Kasner, Docket No. 554
IT IS FURTHER ORDERED that all parties in the WorldCom Securities Litigation who have filed other documents either under seal or with redactions, shall refile those documents by January 16, 2004 in the public record in an unredacted form.
SO ORDERED.
