ORDER
On September 21, 2005, approval was given to the settlement of the WorldCom securities class action. The securities class action spawned derivative litigation involving the Excess Insurers who provided WorldCom with directors and officers insurance. The parties to that derivative litigation have agreed to dismiss their litigation as soon as the settlement of the WorldCom securities class action becomes final. Accordingly, it is hereby
ORDERED that the following actions are placed on this Court's suspense docket: Nos. 03 Civ. 652, 03 Civ. 758, 03 Civ. 7927, 03 Civ. 9460, 04 Civ. 4089, 04 Civ. 4546, and 04 Civ. 4567.
IT IS FURTHER ORDERED that the following motions were granted at a conference of February 15, 2005 and shall be closed on the docket: Francesco Galesi's February 3, 2005 motion to compel Continental Casualty Co. to advance defense costs, appearing on the docket in Nos. 03 Civ. 9460, 04 Civ. 4549, and 04 Civ. 4567. The following motion was denied in the February 15 conference and shall likewise be closed on the docket: Continental Casualty Company's February 7, 2005 motion to stay preliminary injunction pending appeal in No. 04 Civ. 4089.
IT IS FURTHER ORDERED that Bert C. Roberts' November 23, 2004 motion for reconsideration in 04 Civ. 4089, the only motion in these cases that remains unaddressed, is deemed withdrawn and, in the event the settlement does not become final, may be reinstated by the submission of a letter to the Court.
