ORDER TO SHOW CAUSE RE DISMISSAL FOR FAILURE TO PAY FILING FEE


On August 19, 2005, the debtor filed her chapter 7 bankruptcy petition electronically through her attorney, Jody Brion. The filing fee of $209.00 has not yet been paid to the court. AK LBR 5005-2(k)(1)(A) provides that a petition may be dismissed after a hearing on shortened time of not less than 5 days notice in such an event. Therefore,

28 U.S.C. § 1930(a)(1) and Appendix thereto, at ¶ 8 and 9.

Ak LBR 5005-2(h)(2) provides that fees must be "mailed to the Clerk of the Court not later than the next business day or hand delivered to the Clerk of the Court not later than the second business day immediately following the filing [of a document for which a fee is required]."

IT IS HEREBY ORDERED that the debtor, through her attorney Jody Brion, must appear before the undersigned and show cause, if any she has, why this case should not be dismissed for failure to pay filing fee, on FRIDAY, SEPTEMBER 2, 2005, AT THE HOUR OF 10:00 A.M., in the Historic Courtroom, Old Federal Building, 605 West 4th Avenue, Anchorage, Alaska. Any party wishing to appear telephonically at the hearing must contact the In-Court Clerks at (907) 271-2655, ext. 2640, at least two business days prior to the hearing to make the appropriate arrangements.
