IN THE ESTATE OF MITCHELL BOYD WILSON, DECEASED
From the County Court, Edwards County, Texas Trial Court No. 1171 Honorable Polly Jackson Spencer, Judge Presiding
ORDER
Irene Rios, Justice.
On March 12, 2024, appellant filed a notice of appeal stating she wished to appeal "the Final Judgment recited by the Court on February 16, 2024[.]" On April 1, 2024, appellee filed a motion to dismiss this appeal and a request for sanctions, arguing that the trial court had not signed a final judgment or appealable order. Appellant responded to the motion, and appellee filed two supplements and a reply in support of the motion.
On June 27, 2024, we abated this appeal, remanded it to the trial court, and ordered appellant to ensure that a supplemental clerk's record containing an appealable judgment or order was filed in this court by July 17, 2024. On July 16, 2024, appellant filed an unopposed motion seeking an extension of that deadline. On July 19, 2024, the district clerk filed a supplemental clerk's record containing a final, appealable judgment.
We LIFT our June 26, 2024 abatement and REINSTATE this appeal to our active docket. We GRANT appellants' motion for extension of time to comply with our June 27, 2024 order and deem the supplemental clerk's record timely filed. We DENY appellees' motion to dismiss this appeal and request for sanctions.
This court's records appear to show the appellate record is now complete. If the record is not complete, we ORDER appellant to notify this court by August 6, 2024. If appellant does not so notify this court, we will assume the record is complete, and appellant's brief will be due by August 21, 2024.
