Opinion

No. 05-04-01624-CV

Opinion issued January 3, 2005.

Original Proceeding from the 68th Judicial District Court, Dallas County, Texas, Trial Court Cause No. 04-6028.

Writ of Mandamus Dismissed.

Before Justices WRIGHT, O'NEILL, and LANG.

MEMORANDUM OPINION

Relator filed this original proceeding complaining about the trial court's failure to treat their bond as a supersedeas bond to stay the implementation of a temporary injunction which was on appeal to this Court. The trial court has dismissed the underlying action of lack of jurisdiction. Thus, the temporary injunction is no longer in effect and no supersedeas bond need be filed. Accordingly, this original proceeding is moot and the Court DISMISSES the petition for writ of mandamus.
