IN RE THE WILLIAMS COMPANIES, INC., JOHN DEARBORN AND DAVID CHAPPELL, Relators
ORIGINAL PROCEEDING WRIT OF MANDAMUS
125th District Court Harris County, Texas
Trial Court Cause No. 2016-53287
ORDER
On August 24, 2017, relators The Williams Companies, Inc., John Dearborn and David Chappell filed a petition for writ of mandamus in this court. Relators ask this court to order the Honorable Kyle Carter, Judge of the 125th District Court, in Harris County, Texas, to set aside his order dated August 4, 2017, entered in trial court number 2016-53287, styled North American Polypropylene ULC v. The Williams Companies, Inc. Relators claim respondent abused his discretion by granting the second motion compel filed by real party in interest North American Polypropylene ULC.
Relators also filed a motion for temporary stay of proceedings below. See Tex. R. App. P. 52.8(b), 52.10. On August 24, 2017, relators asked this court to stay the trial court's August 4, 2017 order pending a decision on the petition for writ of mandamus.
It appears from the facts stated in the petition and motion that relators' request for relief requires further consideration and that relators will be prejudiced unless immediate temporary relief is granted. We therefore GRANT IN PART relators' motion and issue the following order:
We ORDER the August 4, 2017 order, granting the second motion to compel in trial court cause number 2016-53287, North American Polypropylene ULC v. The Williams Companies, Inc., STAYED IN PART with respect to the documents relators claim are in dispute until a final decision by this court on relators' petition for writ of mandamus, or until further order of this court. We DENY IN PART the motion to stay with respect to the documents relators agree are discoverable to the extent that they have not already been produced.
