STIPULATION AND CONSENT ORDER MODIFYING ORDER GRANTING FINES AND DAMAGES AGAINST UNDISCLOSED BANKRUPTCY PETITION PREPARER MICHAEL WOLF
Whereas the Respondent Michael Wolf disputes findings made characterizing his actions as falling within the ambit of Section 110 of the Bankruptcy Code, and disputes that he is a bankruptcy petition preparer or acted as such in this case, and
Whereas the United States Trustee believes that the actions of Mr. Wolf were violative either of Section 110 or the "debt relief agency" provisions of Sections 526-528, but that there is reason to question whether he prepared the bankruptcy petition and related papers in this case, and whereas Michael Wolf and the U.S.Trustee wish to resolve the dispute by the entry of this Order, establishing terms for modifying the prior Order of Court entered November 9, 2007 (Paper 50),
It is therefore hereby STIPULATED AND AGREED THAT:
(1) Michael Wolf shall not engage in any actions proscribed by section 110 of the United States Bankruptcy Code, and shall consider himself bound by a permanent injunction against such actions;
(2) Michael Wolf shall not engage in the unauthorized practice of law, and shall consider himself bound by a permanent injunction against such actions; and
(3) Michael Wolf shall not violate and shall conform himself to the requirements of Sections 526, 527, and 528 (the "debt relief agency" provisions) of the Bankruptcy Code;
and on the basis of the foregoing, it is hereby
ORDERED, that the fines and damages awarded against Michael Wolf are hereby RESCINDED.
