Opinion

No. 05-06-00762-CV

Opinion issued June 13, 2006.

Original Proceeding from the 194th Judicial District Court, Dallas County, Texas, Trial Court Cause No. F94-03920.

Writ of Mandamus Denied.

Before Justices WHITTINGTON, FITZGERALD, and LANG-MIERS.

MEMORANDUM OPINION

Relator Ivory Wicks contends the trial judge erred in not ruling on relator's application for post-conviction writ of habeas corpus. The facts and issues are well known to the parties, so we need not recount them herein. Only the Texas Court of Criminal Appeals has jurisdiction to issue a writ of mandamus in regards to post-conviction habeas corpus proceedings under article 11.07. See Tex. Code Crim. Proc. Ann. art. 11.07 (Vernon 2005); In re McFee, 53 S.W.2d 715, 717-18 (Tex.App.-Houston [1st Dist.] 2001, orig. proceeding). Accordingly, we DISMISS relator's petition for want of jurisdiction.
