IN RE Daniel WHITE

MEMORANDUM OPINION

Original Mandamus Proceeding PER CURIAM Sitting: Marialyn Barnard, Justice Rebeca C. Martinez, Justice Luz Elena D. Chapa, Justice PETITION FOR WRIT OF MANDAMUS DENIED

This proceeding arises out of Cause No. 2018CR0048, styled State v. Danieli Adrian White, pending in the 227th Judicial District Court, Bexar County, Texas, the Honorable Kevin M. O'Connell presiding.

Relator has filed a two-page handwritten petition for writ of mandamus regarding the trial court's failure to rule on his April 12, 2018 "Motion to Automatically Reverse Magistrate's Finding of Probable Cause on Ground of Structural Error and Release Defendant from Jail." We hold relator has failed to show that he is entitled mandamus relief. See In re Henry, 525 S.W.3d 381, 382 (Tex. App.—Houston [14th Dist.] 2017, no pet.) (denying relief when trial court motion was pending more than 10 days, mandamus record did not contain sufficient information to support allegations in relator's petition, and there was no indication the motion was presented to the trial court). We therefore deny relator's petition for writ of mandamus.
