Dear Clerk of the Court:

This letter is to confirm that the Emergency Motion for a Stay that was filed with the Court of Appeals is being withdrawn as the Emergency Motion for a Stay was already GRANTED by the Trial Court. At the time of filing early this morning, undersigned counsel was unaware that the motion with the trial court had been either denied and/or granted. Upon learning it was granted, undersigned counsel immediately contacted the Court of Appeals, provided them an update, uploaded a copy of the Register of Actions, Order for Stay from the trial Court, and this correspondence.

Please excuse any inconvenience. Mr. Whaley fully intends on proceeding on his Emergency Complaint for Superintending Control and Emergency Motion for Immediate Consideration.
