STIPULATION
IT IS HEREBY STIPULATED by and between the parties to this appeal, appellant Hartford Accident and Indemnity Company ("Appellant"), on the one hand, and appellees the debtors in the underlying bankruptcy cases Western Asbestos Company, Western MacArthur Co. and Mac Arthur Co., the Official Unsecured Creditors' Committee appointed in the underlying bankruptcy cases and the Honorable Charles B. Renfrew appointed by the Bankruptcy Court to represent the interests of future claimants in the underlying bankruptcy cases (collectively, "Appellees"), on the other hand, through their respective counsel of record, that the above-captioned appeal arising from a "Notice of Appeal" filed by Appellant to that certain "Order Granting Motion To Approve Memorandum Of Understanding Regarding Constructive Trust Settlement" entered in the underlying bankruptcy cases, be and hereby is dismissed pursuant to F.R.Bankr.P. 8001(c)(2) and District Court Local Rule 7-11, with each party to bear their own fees and costs in connection with this matter.
