DECISION & ORDER ON MOTION FOR REINSTATEMENT
Renewed motion by Jeffrey J. Weinsten for reinstatement as an attorney and counselor-at-law. Mr. Weinsten was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the First Judicial Department on April 11, 1968, under the name Jeffrey Joseph Weinsten. By decision and order on motion of this Court dated May 6, 1999, Mr. Weinsten was suspended from the practice of law upon his conviction of a serious crime, and the matter was referred to the Honorable Jerome M. Becker, as Special Referee to hear and report. By opinion and order of this Court dated December 11, 2000, Mr. Weinsten was disbarred, effectively immediately, based upon three charges of professional misconduct. By decision and order on motion of this Court dated June 10, 2008, as amended June 20, 2008, Mr. Weinsten's first application for reinstatement was denied. By decision and order on motion of this Court dated January 14, 2010, Mr. Weinsten's second application for reinstatement was denied. This is Mr. Weinsten's third application for reinstatement.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is held in abeyance and the matter is referred to the Committee on Character and Fitness to investigate and report on Jeffrey J. Weinsten's current fitness to be an attorney, including, but not limited to, a review of a determination of the United States District Court for the Eastern District of New York dated January 6, 1998, in the matter entitled United States v Weinsten (see 1998 WL 3381; 1998 US Dist Lexis 61), the sentencing minutes for Mr. Weinsten's underlying conviction, the pre-sentencing report prepared by the U.S. Probation Department, and the respondent's remorse concerning his actions.
