Original Mandamus Proceeding

This proceeding arises out of Cause No. 16616B, styled Roy Watters v. Mike Lopez and Tiffany Liesmann, pending in the 198th Judicial District Court, Kerr County, Texas, the Honorable M. Rex Emerson presiding.

ORDER

Sitting: Marialyn Barnard, Justice Luz Elena D. Chapa, Justice Irene Rios, Justice

On May 22, 2018, relator filed a petition for writ of mandamus and a motion for emergency stay. In his motion, relator asks this court to stay a dismissal hearing to be conducted by the trial court on May 30, 2018, at which time the trial court will consider whether the underlying lawsuit should be dismissed for want of prosecution. Relator also asks us to stay any scheduling order the trial court may issue.

At this time, we DENY relator's motion for emergency stay. Relator is ORDERED to file with this court a copy of any order or ruling issued by the trial court following the May 30, 2018 hearing no later than June 11, 2018.

It is so ORDERED on May 24, 2018.
