Opinion

No. 05-08-00089-CV

Opinion issued January 18, 2008.

Original Proceeding from the Criminal District Court No. 6 Dallas County, Texas, Trial Court Cause Nos. F03-01315-X, F03-41547-X, F03-15187-X.

Before Chief Justice THOMAS and Justices MOSELEY and BRIDGES.

MEMORANDUM OPINION

Relator contends the trial court violated a ministerial duty by ordering relator to consolidate three criminal cases for prosecution in one trial, which is scheduled to begin on January 22, 2008. The record includes a copy of the reporter's record from the January 15, 2008 hearing, but does not contain a written order from the trial court regarding the consolidation. Therefore, based on the record before us, we conclude relator has not shown he is entitled to the relief requested. See Tex. R. App. P. 52.3(j), 52.8(a); State of Tex. ex rel. Hill v. Court of Appeals for the Fifth Dist., 34 S.W.3d 924, 927 (Tex.Crim.App. 2001). Accordingly, we DENY relator's petition for writ of mandamus.
