MEMORANDUM OPINION


This cause is before the Court on relator's unopposed motion to dismiss original proceeding. Relator states that a final judgment in the underlying action has now been signed by the trial court and filed with the Hidalgo County District Clerk. Relator requests that this Court dismiss the original proceeding, leaving the trial court's judgment intact and taxing appellate court costs against the party incurring same.

The Court, having considered the documents on file and relator's unopposed motion to dismiss the original proceeding, is of the opinion that the motion should be granted. Relator's unopposed motion to dismiss original proceeding is granted, and the petition for writ of mandamus is hereby DISMISSED.
