IN THE ESTATE OF TERRY LEE WARE, DECEASED

On Appeal from the County Court Eastland County, Texas Trial Court Cause No. 23-067-CCPR-12394

Panel consists of: Bailey, C.J., Trotter, J., and Williams, J.

ORDER

PER CURIAM

This appeal arises from the trial court's order granting Appellee, Nancy Ware, a family allowance from the Estate of Terry Lee Ware. We previously granted the parties' joint motion to abate this appeal, in which they notified this court that, "through counsel, [the parties] have conferenced regarding settlement of this matter before incurring additional expenses associated with this appeal." The parties were given forty-five days to attend mediation to resolve the dispute, and the appeal was to be reinstated on September 23, 2024. We subsequently received a joint motion to extend the period of abatement, advising that, "due to mediator availability and the attorneys' trial schedules . . . the parties have scheduled mediation for October 24, 2024."

Because the appeal has been reinstated, we abate this appeal for a second time to permit the parties to attend the scheduled mediation. Should they reach a settlement agreement that resolves the controversy, the parties are instructed to notify this court in writing by a motion to dismiss this appeal. See Tex. R. App. P. 42.1. This appeal will be reinstated on November 11, 2024, and the deadline for the reporter's record is stayed during the period of abatement.
