In re Steven Walsh

11th District Court of Harris County, Trial court case number: 2022-75023

ORDER

Veronica Rivas-Molloy Judge

On February 27, 2024, Relator Steven Walsh filed an Application for Writ of Mandamus requesting we vacate the trial court's February 12, 2024 order compelling the deposition of non-party Robert Walsh. See Tex. Gov't Code § 22.221; see also Tex. R. App. P. 52. On February 28, 2024, Relator also filed an "Emergency Motion to Abate" requesting we stay the ordered deposition of Robert Walsh pending adjudication of the Application for Writ of Mandamus. Real Party in Interest filed a response opposing the Motion to Stay. Relator's Motion for Stay is granted. The compelled deposition of Robert Walsh is stayed pending adjudication of Relator's Writ of Mandamus or until further order of this Court.

We request a response to the Application for Writ of Mandamus from Real Party in Interest. The response(s), if any, is due on or before Monday, March 11, 2024.

Relator is directed to supplement his appendix with (1) the transcript of the February 26, 2024 hearing referenced in his petition; and (2) signed order, if any, denying Robert Walsh's Motion to Reconsider and Void the February 12, 2024 order. See Tex. R. App. P. 52.7(a)(1). Relator is ordered to file such supplementation on or before Monday, March 11, 2024. Failure to supplement the record as directed may result in dismissal of Relator's petition.

It is so ORDERED.
