Relator, Walmart Stores Texas, LLC, has filed a petition for a writ of mandamus and a "Motion for Emergency Stay of Discovery Order Made the Basis of Petition for Writ of Mandamus." The motion is granted. The trial court's October 3, 2017 "Order Granting Plaintiffs' Motion to Compel Production of Withheld Documents from Defendant Wal-Mart Stores Texas, LLC," in cause number 14-DCV-219810 in the 268th District Court of Fort Bend County is stayed. The stay is effective until disposition of relator's petition or further order of this Court.
The Court requests a response to the petition for a writ of mandamus from real party in interest, Miriam Nelida Gigena, Individually, and as Representative of the Estate of Cristhian Eduardo Cardozo, Deceased, and as Next Fried of C.G.C. and L.P.C., Minors. The response, if any, is due no later than 20 days from the date of this order. Any other real party in interest in this proceeding who wishes to respond to the petition may do so, and any response should be filed no later than 20 days from the date of this order.
