ORDER APPROVING CHAPTER 11 TRUSTEE'S MOTION TO APPROVE SETTLEMENT, TO APPROVE ATTORNEYS' FEES AND FOR PAYMENT OF ATTORNEYS' FEES FROM SETTLEMENT PROCEEDS, AND MOTION TO APPROVE PAYMENT OF DEPOSITION AND OUT-OF-POCKET EXPENSES (PROPOSED)

THIS MATTER came before the Court on the Motion of Diana C. Carey, Chapter 11 Trustee for an Order Approving Settlement, To Approve Attorneys' Fees and For Payment of Attorneys' Fees From Settlement Proceeds, and To Approve Payment of Deposition and Out-Of-Pocket Expenses (the "Motion"). Based on the Motion, and the records and files herein, the Court finds that good cause has been shown to grant the Motion.

NOW, THEREFORE,

IT IS HEREBY ORDERED as follows:

1. The settlement between the Trustee and Steve Hanks as described in the Motion shall be and hereby is approved;

2. The Trustee is authorized and directed to take all necessary steps to complete the settlement contemplated by the agreement;

3. The Trustee is authorized and directed to pay her special counsel, Romero Montague P.S., from the proceeds of the Settlement, the sum of $833.33, representing onethird of the sums recovered in the Settlement pursuant to the Order On Trustee's Application to Employ Special Counsel dated March 21, 2003; and

4. The Trustee is authorized and directed to pay her special counsel, Romero Montague P.S. the sum of $6,484.63, representing the costs/expenses incurred by RM and the costs/expenses estimated to be incurred by RM as a result of the depositions in the lawsuit with Crump Northwest Services, Inc.
