Opinion

No. 05-06-00354-CV

Opinion Issued August 2, 2006.

Appeal from Original Proceeding from the 192nd Judicial District Court, Dallas County, Texas, Trial Court Cause No. 05-10839-K.

Writ of Mandamus Dismissed.

Before Justices MOSELEY, BRIDGES, and FRANCIS.

MEMORANDUM OPINION

On March 17, 2006, relators filed a petition for writ of mandamus and a motion for emergency relief. Relators complained that the trial court's February 21, 2006 orders compelling arbitration and granting Netrake's motion to enforce arbitration provision were an abuse of the trial court's discretion. On July 13, 2006, the trial court's Order to Vacate its February 21, 2006 Order Compelling Arbitration and Order Granting Netrake's Motion to Enforce Arbitration Provision was filed with this Court. By letter dated July 17, 2006, we informed the parties that after five days the petition would be dismissed as moot, unless the parties advised the Court otherwise. The parties have not responded. Accordingly, this petition for writ of mandamus is DISMISSED as moot. Additionally, all other requests for relief are DENIED as moot.
