ORDER DISMISSING THE AVENTIS DEFENDANTS WITH PREJUDICE


This matter being presented to the Court in connection with the unopposed motion of plaintiff Bristol-Myers Squibb Company ("BMS") to dismiss Aventis S.A., Aventis Animal Nutrition S.A., Aventis Animal Nutrition Inc., Aventis CropScience USA Inc., Rhone Poulenc Rorer Inc., Hoechst Marion Roussel S.A., and Roussel Corporation (the "Aventis Defendants") with prejudice,

IT IS HEREBY ORDERED that the Complaint in this action is dismissed with prejudice solely against the Aventis Defendants. This Order is without prejudice to BMS' claims against any other defendant or alleged co-conspirator in the above-captioned case.
