STIPULATION AND (PROPOSED) ORDER REGARDING BRIEFING SCHEDULE ON CLASS PLAINTIFFS' MOTION FOR PRELIMINARY APPROVAL OF SETTLEMENT BETWEEN CLASS PLAINTIFFS AND DEFENDANTS MITSUI CO. LTD., MITSUI CO.(U.S.A.) INC., AND BIOPRODUCTS, INCORPORATED

IT IS HEREBY STIPULATED AND AGREED, by and between Lead Counsel for the Class Plaintiffs and Counsel for the Direct Action Plaintiffs, that the following schedule shall govern the briefing schedule on Class Plaintiffs' Motion For Preliminary Approval Of Settlement Between Class Plaintiffs And Defendants Mitsui Co. Ltd., Mitsui Co. (U.S.A.) Inc., And Bioproducts, Incorporated ("Class Plaintiffs' Motion") which was recently filed and served.

1. Direct Action Plaintiffs shall serve their response to the Class Plaintiffs' Motion, including any motion to intervene on or before Friday, November 21, 2003;

2. Class Plaintiffs shall serve any reply in support of the Class Plaintiffs' Motion and any opposition to any motion to intervene by Direct Action Plaintiffs on or before Thursday, December 4, 2003;

3. Direct Action Plaintiffs will file any reply in support of any motion to intervene on for before Thursday, December 11, 2003; and

4. The Court will hold a hearing on the issues raised in the Class Plaintiffs' motion and the other briefing papers addressed in this Order on Wednesday, December 17, 2003 at 2 p.m.
