ORDER DISMISSING DEFENDANTS F. HOFFMANN-LA ROCHE, LTD., HOFFMANN-LA ROCHE, INC. AND ROCHE VITAMINS, INC. WITH PREJUDICE


This matter being presented to the Court in connection with the unopposed Bayer Corporation's Motion to Dismiss Defendants F. Hoffmann-La Roche, Ltd., Hoffmann-La Roche, Inc., and Roche Vitamins, Inc. with Prejudice, it is hereby:

ORDERED that the Complaint in this action is dismissed with prejudice solely against defendants F. Hoffmann-La Roche, Ltd., Hoffmann-La Roche, Inc., and Roche Vitamins, Inc. This Order is without prejudice to Bayer Corporation's rights or claims against any other defendant in this litigation.
